You will be responsible for any existing room damages if you fail to notify us of any room issues within 24h after your StartDate or MoveIn Date. (5) CHANGE START DATE: If IncomingRenter & LeavingRenter mutually agree on a MoveIn/MoveOut Date different from IncomingRenter StartDate, then: (a) LeavingRenter (and not Super) must pass keys directly to IncomingRenter; (b) any resulting prorated rent/deposit differential must be mutually agreed to and satisfied (paid) in advance directly between LeavingRenter and IncomingRenter (contact info emailed, check SPAM); (b) any LeavingRenter bandspacesnyc.com/DEPOSIT_RETURN is based only on IncomingRenter booked StartDate (8th,15th,22nd=.75,.5,.25/Mo respectively); (c) technical StartDate and MoveOutDate remain unchanged; (d) LeavingRenter is responsible for the rent and the room until MoveOutDate; (e) IncomingRenter is responsible for the rent and the room starting on StartDate. GUIDELINES & RENTER POLICY: _________________________________________________________ (Renter Policy & Guidelines may be amended or changed at any time without notice. Updated copy will be emailed to you upon request. Infringement of any guidelines/policies herein may result in immediate termination without notice). INITIAL PAYMENT: We require 2-month deposit plus pro-rated 1st month rent. Min. stay=3 months & month-to-month thereafter (except bandspacesnyc.com/SHORT_STAY). SECURITY DEPOSIT: Deposit = 2 months rent. We require minimum 2 months bandspacesnyc.com/NOTICE when you decide to leave. The only accepable methods of giving notice are by going to either bandspacesnyc.com/NOTICE or bandspacesnyc.com/RENT. VacancyDate must be on 1st of month. There are no refunds.* Your deposit is returned to you in the form of your final 2 months rent being at no charge*, provided you leave timely and in accordance with this policy and with the conditions at bandspacesnyc.com/MOVEOUT and have not damaged the space. *(If you give sufficient Notice and leave before your VacancyDate and a ReplacementRenter is found (by you or us), or if you pay rent after Notice, you may be eligible for a bandspacesnyc.com/DEPOSIT_RETURN). **If you give late notice, you will lose your deposit.** RENT (after initial payment) is *always paid on 1st* (including any prorated payments) in 1 single transaction. You may pay early but not before 19th (except 1stMoRent). You will receive approximately 1 months prior notice, provided you are timely with all rent payments. *If you have not seen a *Rent Raise* email by your 12th (and 24th and 36th etc) month of rental, you are responsible for requesting this information from us before your rent raise date*. Rent is strictly free-market and will be raised with each new booking. SUMMER A/C SURCHARGE: there is a summer A/C surcharge of 10% for all renters (regardless of length of stay or StartDate or VacancyDate or prepayment or discount type) on top of your rent for the months of July and August. When A/C is in use, make sure windows remain closed. NOISE LEVELS: After 12 midnight, please make sure windows are closed and bring noise level down LATENESS: -If rent (or any portion thereof) is received after 1st of month, your rent (or unpaid portion) is subject to a 3% surcharge (plus $5 per day for rent [and any balances] after the 5th). Your rent (or unpaid portion) due becomes [your rent (or unpaid portion) x 1.03], payable immediately. -If later than 3rd of month, you will receive a final warning. -If later than 5th of month (10 AM), you will receive Termination Notice; your space will be set as Available; any balance due will be deducted from your depositand your space will be shown to prospective renters for booking purposes. -If rent is received after the 2nd of the month more than twice, your rent will be raised by $25 per month thereafter. If you are again late twice, the same will recur, etc. INSURANCE: You must insure (for loss/theft/damages) all property stored in or brought to the Studios. PENALTIES / FEES: KeySet replacement: $35 (or $15 for room key, $20 for MainDoor key - limit copies for your own security) / Original lock cylinder loss or replacement w/ new key $125 / Smoking-Air Cleaning Deposit deduction: $250 / Leaving Main door propped open $50-$100 / Failure to leave up (or removal of any) shelves: $100 / Late Moveout Penalty: $250 plus any of: $200 Lock-Change Fee + $200-$500 Cleanup/Storage Fee + $2000-$5000 Property Movers Fee + daily storage fee; any remaining deposit due to you will also be reduced pro rata, per day late. / Failure to leave room *broom clean*, with walls and ceiling painted white: $200 / Leaving garbage/mess/gear anywhere in or near the space (outside your room): $50-$100. *NOTE*: *If you engage in any illegal or negligent or harmful activities, your rental will be immediately cancelled; you will be compelled to leave immediately; your property will be removed & locks changed without notice & your full deposit will be immediately forfeited. If you pass keys or grant access to anyone other than as instructed per prior sentence, any bandspacesnyc.com/DEPOSIT_RETURN will be forfeited and you will be held responsible for any resulting damages. ::::::::::::::::::::::::::::: _________________________________________________________ ROOM & BUILDING RULES -No smoking (including cigarettes, cigars, pipes, e-cigarettes etc) or vaping; no candles, or incense, or any lighted flames in the rooms or anywhere in the building. Offenders are subject to immediate removal without notice. -If ever you smell gas or detect fire, IMMEDIATELY evacuate building; alert bandspacesnyc.com/SUPER and bandspacesnyc.com/CONTACT management. -Installation of additional locks or locks that are not Master-keyed to our system is prohibited. -Light bulbs, door/doorknob/lock maintenance, cleaning, mold and vermin/pest eradication and all maintenance of your room are your responsibility. No locksmith charges will be reimbursed. -Garbage must be in black trash bags and placed in the designated trash areas. Any items that do not fit in trash bags must be removed (by you) away from the space (not left on curb) or you will be charged. You must keep your room in an orderly manner. No food garbage may be left overnight. -No items (incl bicycles, scooters etc) may be stored or left outside your room (incl hallways, curb). -If your room loses power, flip the appropriate breaker on the labelled hallway electric panel. -All items/materials brought into or installed in the space must be legal, non-flammable, flame retardant and code compliant (including any soundproofing, foam, wall-covering, carpeting). Acoustic blankets & coverings must be sprayed with Fire Retardant Spray (Firez Off/Excel); wood must be coated with an intumescent coating (Scotchkote). -Bring and always use electric surge protectors for all gear. -No illegal activities are allowed in the building. -No living: the Studios are for storage and/or studio purposes only. Anyone found to be living in the Studios will be removed without notice. -No product sales or merchandising is allowed in the building. -None of the following is permitted in the building: parties; gatherings. -No videos or filming may be shot in the building. -None of the following may brought into, or stored in, the building: pets, animals, mattresses, motorcycle, scooter, moped, or any gas-powered vehicle; any flammable, explosive, combustible, hazardous or toxic materials or substances (including gas, propane, methane, paint thinner etc); any substances or materials that give off odors or fumes; firearms or weapons of any kind; art supplies. -Paint may be stored provided it is completely sealed and properly stored (1 gallon max per room). -Heaters/space heaters without auto-timer turnoff are not permitted. Heaters/space heaters must always be turned off except when someone is in the room. No combustible heaters are permitted. -No hoarding. Storage of non-music related items and/or excessive storage of any items may result in immediate removal and rental termination without notice. -Windows may not be opened for security reasons. -No Loitering. You may only use your own room and the bathroom. Visiting or playing music or storing items or engaging in any activities in areas of the premises other than your own rented room, including other floors, is strictly prohibited and may lead to trespassing charges. -Elevators: maximum occupancy & weight rules must be observed at all times. Elevators are provided for assistance and are not essential to space functioning; use stairs if elevators are in use or out of service. Per Policy, there is no rent abatement if elevator is out of service (or for any other reason). -Room Condition on MoveOut: to avoid losing any of your deposit, you will need to restore your room to its original condition (*other than Improvements - see below) prior to departure (ie walls & ceiling painted white), and leave it *broom clean*. -Alterations*: You may construct bandspacesnyc.com/SHELVES and/or additional soundproofing. All materials must be fireproof. No nails may be used. Use screw anchors and fasten fixtures to metal studs (which are placed every 16in - use magnetic studfinder) to avoid damaging walls (& masonry anchors if going into brick/block). Sprinkler heads (normally round white discs on the ceilings) may not be obstructed in any way; no item or object may be constructed or stored within 12 inches of any sprinkler head. *Construction of any partitions or booths requires prior written approval from management; such additions must be removed before departure and will require separate RestorationDeposit before construction. Any shelves and/or additional non-structural fixed soundproofing (second door / thickened walls) may not be removed & must be left in place when you leave (you may also leave up any soft soundproofing)*.
